Specific Terms and Conditions (SingNet Broadband Value Added Service)
| 1. | These Specific Terms and Conditions shall apply in addition to:- (a) Singtel’s General Terms and Conditions of Service; (b) Singtel’s Billing Terms; (c) Singtel’s Terms of Use; (d) Specific Terms and Conditions (SingNet Broadband Access Service); (e) Promotional Terms and Conditions (where applicable). |
| 2. | In the event of any inconsistency between the Specific Terms and General Terms, the Specific Terms shall prevail. |
| 3. | These Specific Terms and Conditions may be amended by SingNet from time to time by notice to the Customer in such manner as SingNet deems appropriate. The Customer shall be bound by the terms and conditions so amended. If the Customer continues to use the services provided by SingNet after such notice, the Customer shall be deemed to have accepted the amendment. |
| 4. | The Value Added Service (“VAS”) is only provided to a Customer who subscribes to SingNet Broadband Access Service. |
| 5. | The VAS is provided to the Customer on a personal usage basis for the sole purpose of the Customer’s own use. |
| 6. | SingNet reserves the right to amend the scope and specifications of the VAS from time to time (eg. Introducing new applications, modifying user interface etc). SingNet will use reasonable endeavours to give the Customer notice of any change to the VAS. |
| 7. | The VAS is provided on a “as is” basis without any warranty of any kind. All warranties, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a purpose are excluded to the fullest extent permitted by law. |
| 8. | The Customer shall assume all risks including inherent risks associated with the VAS and accepts that SingNet shall not be liable for any loss or damage caused to the Customer by the use of the VAS. |
| 9. | The Customer shall comply with all applicable laws including copyright laws when using the VAS and ensure that no copyright or other unauthorized material or content is obtained, stored, copied, distributed, used or misused in any manner without the consent of the lawful owner. The Customer shall bear the sole responsibility for use of the VAS and all material or content stored through use of the VAS. |
| 10. | The Customer shall be solely responsible for managing the use of the storage capacity (if applicable) of the VAS such that it is within the capacity allocated to the Customer or as may be stipulated by SingNet from time to time. |
| 11. | The Customer agrees to indemnify and hold harmless SingNet at all times from and against any and all actions, claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) caused by or arising out of any act or omission of the Customer, breach of any terms and conditions applicable to the Customer including any libel, slander, infringement of intellectual property rights in connection with the use of the VAS. |
| 12. | The Customer shall protect the secrecy of his Login User ID and Password at all times and shall ensure that the Login User ID and Password are not revealed or disclosed in any manner whatsoever to any person or persons whomsoever. The Customer shall be fully responsible for all use and liability resulting from access to the VAS with his Login User ID and Password. SingNet shall hold the Customer solely responsible for unauthorized transactions under the Customer’s account. |
| 13. | The Customer shall inform SingNet if he suspects that his Login User ID and Password has been compromised in any manner and change his Password immediately. |
| 14. | If SingNet identifies a fault in the VAS, SingNet shall use its best endeavours to rectify the fault as soon as it is reasonably possible. However, SinNet will under no circumstances be liable to the Customer for any failure, disruption of service, virus, loss of data, loss or damage to property or any other loss, damage, costs, expenses or claims of whatever nature that results from the failure or breakdown of any VAS. |
| 15. | SingNet may charge the Customer for reasonable cost and expenses in providing maintenance of VAS where the need for such maintenance arises out of the Customer’s misuse of the VAS or failure to comply with any of the terms and conditions that are applicable to the Customer. |
| 16. | SingNet reserves the right to manage and control access to any computer or any SingNet system or any computer linked to any SingNet system and any data stored therein, in a manner deemed appropriate by SingNet, and to delete any data (whether belonging to, provided or stored by the Customer or otherwise), notwithstanding that such access and the storage of such data is a requirement or constitutes a part of the VAS. |
| 17. | SingNet may use and shall allow any of its affiliates to use any personal information it obtains directly from the Customer or through the Customer's use of the VAS for the purpose of managing the Customer's account, for facilitating transmission of marketing/promotional messages, for providing and improving the VAS and providing information about the VAS and/or for related administration/direct marketing purposes. |
| 18. | The VAS will be billed together with the SingNet Broadband service bill. The Customer shall pay the applicable charges in accordance with the payment terms imposed by SingNet from time to time. |
| 19. | SingNet reserves the right to change the fees and charges and payment terms at any time without prior notice. |
| 20. | All fees and charges are subject to goods and services tax at prevailing rates. |
| 21. | Early termination charges shall be applicable for termination of VAS before the applicable minimum subscription period. |
| 22. | SingNet reserves the right to terminate or discontinue the VAS, with or without cause at any time. SingNet shall not be liable to the Customer or any other person for any damages, losses, cost or expenses howsoever caused by or arising out of termination of the VAS. |
| 23. | Subject to the applicable minimum subscription period, the Customer may terminate the VAS, with or without cause at any time by one (1) calendar month’s prior notice in writing. The date of notice of termination herein stated shall be the date of receipt of the notice thereof by SingNet. All outstanding charges or early termination charges (if applicable) shall be payable by the Customer for VAS consumed up to and including the last day of service. |
| 24. | The Customer acknowledges that once the VAS is terminated, all data stored by the Customer in relation to the VAS will be deleted and the Customer account removed. If the Customer requires the service in future, the Customer will have to subscribe to the service as a new Customer. The Customer shall not hold SingNet responsible and shall hold SingNet harmless from any claim arising from or in connection with the deletion or removal of such data. |
| 25. | SingNet requires the Customer to sign into his/her free SingNet Email account at least once every 6 months. Failure to do so will (unless provided otherwise in an offer for paid services) result in termination of Customer’s SingNet Email account and the Customer may permanently lose his/her content on that portion of the SingNet Email Service. |
| 26. | If the Customer signs up for a paid portion of the SingNet Email Service and fails to make an on-time payment, SIngNet reserves the right to suspend or cancel that service in its sole discretion. |
| 27. | The Customer acknowledges that any data deleted or removed for any reason will no longer be available for retrieval subsequently. Accordingly, in the event that the subscription to the VAS or SingNet Broadband service account is resumed or reinstated after the account has been terminated, any data previously stored under that service account will no longer be available for retrieval.

| 28. | Notwithstanding anything herein contained, SingNet shall not be liable to the Customer in contract, tort (including any negligence whatsoever) or otherwise in respect of any claim brought by a third party nor shall SingNet be liable to the Customer or any third party whomsoever for any indirect, special or consequential damages including without limitation, loss of business, loss of revenue or loss of profit whether or not SingNet was or should have been aware of the possibility that such damage or loss could occur.

| 29. | These Specific Terms and Conditions shall be subject to and construed in accordance with the laws of the Republic of Singapore and the Customer and SingNet hereby submit to the exclusive jurisdiction of the Courts of the Republic of Singapore.
