Terms and Conditions of Service - Singtel eBill

Terms and Conditions of Singtel eBill
1. | Incorporation by Reference In addition to: a. Singtel's General Terms and Conditions of Service b. Singtel's Billing Terms and Conditions c. Any other applicable Specific Terms and Conditions and Promotion Terms and Conditions, which terms and conditions are deemed incorporated by reference, the Customer shall be bound by the following Terms and Conditions. |
2. | Definitions and Interpretation "Account" means any account of a Customer with the Service Provider with respect to the provision of any Service; "Bill" means any bill, invoice or statement issued or rendered by the Service Provider or its billing agent of any charge, fee or other sum stated therein as due and payable to the Service Provider and/or of any sum or sums or balance due or payable to or from the Service Provider in respect of any Service or on any Account; "Customer" means any individual who applies or subscribes for or utilises any Service; "Damages" means all direct and indirect liabilities, losses, damages, costs and expenses, fines and penalties including loss of profits, business or anticipated savings or any other consequential losses; "E-mail" means an electronic mail to which communication may be sent or received; "E-mail Address" means the electronic mail address specified by the Customer to the Service Provider as a communication mode to receive notification from the Service Provider; "Password" means a set of unique identification code made available to or created by Customer to access Singtel eBill; "Service" means any telecommunications, broadcasting or other service (including the supply, rental or installation of any equipment and any service comprised in any request by Customer) offered or provided by any Singtel Group Corporation to a Customer from time to time; "Service Provider" means in relation to any Service the Singtel Group Corporation which contracts or agrees with the Customer to provide or make available that Service; "Singtel" means Singapore Telecommunications Limited and its successors; "Singtel Group Corporation" means any corporation comprising Singtel and its related corporation; "Singtel eBill" means the electronic Bill Presentation and Payment service operated by Singtel; "SMS" means short message service sent or received via a mobile phone; "SMS alert" means short message service triggered from Singtel eBill; "SMS Number" means a mobile phone number to which an SMS may be sent or received. |
3. | Use of Singtel eBill |
3.1 | To use Singtel eBill, the Customer may log-on to Singtel My Account to view the presented Bill and/or to carry out other transactions from time to time. |
3.2 | The Customer may request the Service Provider to send a hard copy of the Bill by post, subject to a charge of SGD 5.45 (GST incl.) for each Bill dispatched. |
3.3 | The Service Provider will notify the Customer when the Customer's latest Bill is presented on Singtel eBill. Such notification will be made via E-Mail to the E-Mail Address provided by the Customer. |
3.4 | The Service Provider may, in addition to the E-Mail notification referred to in clause 3.3 above, notify the Customer via SMS and/or SMS alert to the SMS Number provided by the Customer. The Customer may apply to opt out of the SMS alert service via Singtel My Account website. However, notwithstanding the Customer's request to opt out of the SMS alert, the Service Provider has the sole discretion to send notifications in relation to the Customer's bill to the Customer via SMS. The Customer acknowledges that the additional SMS alert service is not mandatory and will only be offered subject to availability and at the Service Provider's sole discretion. |
3.5 | The Customer shall be responsible to notify the Service Provider of a valid and accurate E-Mail Address and SMS Number (if applicable). The Customer shall also be responsible to notify the Service Provider of any change in the E-mail Address and SMS Number (if applicable). The Bill shall be deemed delivered to the Customer on the date of first transmission or transmission attempt by the Service Provider to the last known E-Mail Address. |
3.6 | The Customer shall be responsible to keep the Password secret and not to divulge the Password to any third party. The Service Provider shall not be liable to the Customer for any illegal or unauthorised access or use of the Account by third parties. |
3.7 | The Customer shall be responsible to log-on and view the Bill in a timely manner and to notify the Service Provider if there is any delay or failure in Bill presentment. |
3.8 | The Customer acknowledges that whilst E-mail is used as a means of communication between the Customer and the Service Provider, the Customer shall assume the risks inherent in such form of communication including the risk of non-delivery, wrong delivery, disruption in delivery or truncated or illegible delivery. The Service Provider shall not be liable to the Customer for any Damages arising by reason of use of such communication. |
3.9 | The time for making payment of the Bill and for notifying the Service Provider of any error, inaccuracy or discrepancy with respect to any amount stated in the Bill shall remain unaltered by Singtel eBill and these billing terms shall continue to be governed by Singtel's General Terms and Conditions of Service and Billing Terms. |
4. | Charges |
4.1 | Singtel eBill is a free service offered by Singtel. Singtel reserves the right to impose any charges for use of Singtel eBill at any time by prior notification to the Customer in accordance with Singtel's General Terms and Conditions of Service. |
5. | Termination or Discontinuation of Singtel eBill |
5.1 | The Service Provider has the absolute discretion to modify, restrict, suspend, or discontinue Singtel eBill anytime without giving any reason by prior notification to the Customer in accordance with Singtel's General Terms and Conditions of Service. |
5.2 | If:- (i) the Customer furnishes an erroneous E-Mail Address to the Service Provider; or (ii) the Service Provider is unable to transmit notification of Bill presentment via E-Mail; or (iii) the Customer defaults in making payment, the Service Provider has the discretion to send a hard copy of the Bill to the Customer. Each Bill will be charged at SGD 5.45 (GST incl.) and will be sent by post to the Customer's correspondence address last known to the Service Provider. |
5.3 | The Service Provider shall terminate Singtel eBill, within a reasonable time after the Customer discontinues all Services with the Service Provider and discharges all payment obligations. |
6. | Disruption to Singtel eBill |
6.1 | The Customer acknowledges that Singtel eBill is available upon activation, on a 24 hours basis, subject to service disruption that may be caused by scheduled maintenance, electrical or network failure or other causes beyond the Service Provider's control. The Service Provider shall not be liable to the Customer for any such disruption in access to Singtel eBill. The Service Provider shall use its best efforts to restore Singtel eBill in the event of disruption caused by an external event. |
7. | Liability |
7.1 | The Service Provider shall not be liable to the Customer for any Damages suffered or incurred by the Customer which may arise (whether in contract, tort or otherwise) by reason of or in connection with the provision of Singtel eBill. |
7.2 | To the extent permitted by law, the Service Provider excludes all warranties, rights and remedies (including warranties implied by statute or otherwise) that the Customer would otherwise be entitled to by law. |
8. | Miscellaneous |
8.1 | In the event of any inconsistency between the Bill available on Singtel eBill and the Bill available on the Service Provider's billing system, the latter shall prevail and shall be deemed final and conclusive. |
8.2 | These Terms and Conditions may be amended by the Service Provider from time to time by notice to the Customer in accordance with Singtel's General Terms and Conditions of Service. The Customer shall be bound by the terms and conditions so amended. In any event if the Customer continues to use Singtel eBill after such notice the Customer shall be deemed to have accepted the amendments. |
8.3 | These Terms and Conditions shall be subject to and construed in accordance with the laws of the Republic of Singapore and the Customer hereby agrees to submit to the exclusive jurisdiction of the courts of the republic of Singapore. |
